These Terms of Service apply to our websites, including bettercareinsurance.com and any other site that posts a link to this page (collectively, the “Site”). By accessing our Site, you consent to these Terms of Service (“Terms”) and our collection, use and sharing of your information as described in our Privacy Policy, or any other terms linked to these Terms. 2. Ownership of Site Content

5. BetterCare Trademarks

BetterCare trade names, trademarks, service marks, logos, domain names‎, all page headers, graphics, images, symbols, and other BetterCare marks found at the Site are the proprietary property of BetterCare (collectively the “Marks”). Use of the Marks is strictly prohibited without the prior written consent of BetterCare.

6. Third Party Trademarks

The trademarks of third parties may also appear on the Site from time to time; you may not use these trademarks without prior written permission of their respective owners. You acknowledge and agree that nothing on the Site grants, expressly or implicitly, by estoppel or otherwise, any right or license to use any of these trademarks, nor may anything be construed to mean that BetterCare has authority to grant any right or license on behalf of any third-party trademark owner.

7. Restrictions, Limitations and Conditions of Use

Any unauthorized use of this Site or Site Content for any purpose is prohibited. We may suspend or terminate the availability or your use of the Site (and any elements or features of it), in whole or in part, for any reason, and at any time, in our sole discretion, and without advance notice or liability.

You agree that you will not: (i) use our Site for any political or commercial purpose, aside from the purchase of goods or services if offered for sale through the Site by BetterCare and its affiliates; (ii) engage in any activities through or in connection with our Site that attempt to or actually do harm any individuals or entities or are unlawful, offensive or abusive, or that violate any right of any third party, or are otherwise objectionable to BetterCare; (iii) reverse engineer, decompile, disassemble, reverse assemble or modify any Site source or object code or any software or other products, services or processes accessible through any portion of our Site; (iv) engage in any activity that interferes with another user’s access to our Site or the proper operation of our Site, or otherwise causes harm to our Site, BetterCare or other users; (v) use Site Content in a manner that suggests an unauthorized association with any of our products, services or brands; (vi) interfere with or circumvent any security or access feature of our Site; or (vii) otherwise violate these Terms of Use.

BetterCare has no obligation to monitor your interaction with the Site, but reserves the right to review ‎or monitor the Site and any user submissions in its sole discretion.

In using the Site, you may find that BetterCare provides hyperlinks to one or more third-party ‎websites (the “Linked Sites”). BetterCare provides these links as a convenience for you and other ‎users but is not responsible for the content of, or links to and from, the Linked Sites. 9. Disclaimer, Limitation of Liability, and Indemnification

You hereby ‎agree to ‎indemnify the BetterCare Insurance Services LLC Parties from and against any and all claims, liabilities, and ‎expenses ‎‎(including reasonable attorneys’ fees), resulting from your use of the Site or any ‎breach of ‎these Terms by you.‎

10. Ability to Accept Terms

You affirm that you are the age of majority in your jurisdiction and are fully able and competent to ‎enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth ‎in these Terms, and to abide by and comply with these Terms. You agree to defend, indemnify and hold harmless BetterCare, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Service or your use of the Services, including but not limited to any use of the Site Content, services and products, other than as expressly authorized in these Terms of Service.

13. Choice of Law and Forum

These Terms will be governed by and construed in accordance with the laws of the State of Texas ‎without giving effect to any principles of conflicts of law. All disputes arising under, or in any way connected with use of this Site, shall be litigated ‎exclusively in the state and federal courts residing in the State of Texas and in no other ‎court or jurisdiction. You hereby submit to the jurisdiction of the state and federal courts ‎sitting in Bedford, TX.‎

15. Termination/Exclusion

16. User Suggestions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other ‎information provided by you to BetterCare through the Site are not confidential and you grant us a ‎worldwide, perpetual, royalty-free license to distribute, publish, modify, edit or otherwise use your ‎submissions. BetterCare shall be entitled to the unrestricted use and dissemination of these ‎submissions for any purpose, commercial or otherwise without any acknowledgement of or ‎compensation to you.

17. Changes to Terms

We may revise these Terms at any time, with or without notice, by updating this page, and such ‎revisions will be effective upon posting to this page. Please check these Terms periodically for any ‎changes. Your continued use of the Site following the posting of any revisions to these Terms will ‎mean you accept those changes. We reserve the right to alter, suspend or discontinue any aspect of ‎the Site, including your access to it. Unless explicitly stated, any new features will be subject to ‎these Terms.

20. Product Restrictions

Policies and products are not available in all states. Exclusions and misstatement and misrepresentation restrictions may apply. The quote, policy and plan comparisons and information we provide are furnished by the individual insurance companies, and are subject to change without notice and/or underwriting qualification by the specific insurance company to which the application is submitted. A quote should not be construed as a commitment from the insurance company to actually issue that policy or any other policy to you. All quotes that we present are based on the information you have provided us at our request. You are responsible for ensuring that information you provide in connection with any quotation or inquiry through the Site is accurate and up to date. You may change or edit your information at our Site by contacting us via email at info@bettercareinsurance.com.

To purchase an insurance policy, you must submit a completed application to the insurance company, which will then review and underwrite your application along with any other information that may be gathered from sources such as, but not limited to, the Department of Motor Vehicles, credit bureaus and the Medical Information Bureau. Following that review and underwriting analysis, the insurance company will then determine whether you are eligible for insurance and, if so, the precise premium to charge you for the insurance policy you seek. This underwriting process may result in higher or lower premiums than your quote.

21. Consumer Protection Notice

If you are a consumer, the provisions in these Terms of Use are intended to be only as broad and ‎inclusive as is permitted by the laws of your state of residence. Certain states, like New Jersey, ‎have heightened consumer protection laws that may make certain terms of these Terms of Use ‎inapplicable to you. Specifically, if you are a New Jersey consumer, the terms of Sections 8, 9, 12, 13, and 14 do not limit or waive your rights as a consumer under New Jersey law and the ‎provisions in these Terms of Use, as they pertain to you, are intended to be only as broad and ‎inclusive as is permitted by the laws of the State of New Jersey. No provision of these Terms of ‎Use shall limit or waive your rights as a consumer under the law of your state of residence. In any ‎event, BetterCare reserves all rights, defenses and permissible limitations under the law of your ‎state of residence.‎

Medicare Advantage Disclaimer

BetterCare Insurance Services LLC is a licensed insurance agency doing business as BCI Insurance Services in California.

Plans are covered by a Medicare Advantage organization with a Medicare contract. Enrollment in the plan depends on the plan’s contract renewal with Medicare.
